The Justice Department said Friday it is updating emergency scheduling actions for 7-hydroxymitragynine, or 7-OH, and three related opioid substances: mitragynine pseudoindoxyl (MGPI), MGM-15 and MGM-16.
According to the department, the Drug Enforcement Administration is issuing two new Notices of Intent based on new scientific information and recommendations from the Department of Health and Human Services. One notice will be reissued for MGM-15 and MGM-16 without changing the current scheduling approach. The other will be a new notice for 7-OH and MGPI that uses updated concentration and ratio thresholds.
HHS recommended Schedule I control for 7-OH and MGPI when either substance, alone or combined, exceeds 1 milligram per gram in solid products or 1 milligram per milliliter in liquid products, or when the mitragynine-to-substance ratio is below 100 to 1. HHS said that approach is meant to help distinguish products that have been intentionally enhanced or concentrated from products whose alkaloid composition is more consistent with botanical kratom.
The department also said DEA temporarily placed MGPI, MGM-15 and MGM-16 into Schedule I on Aug. 26, 2026, and that those controls will stay in effect during the new 30-day Notice of Intent period and until DEA issues a new temporary scheduling order. For 7-OH, DEA had not yet issued a temporary scheduling order and said it will reissue a new Notice of Intent reflecting HHS’s updated scientific recommendation.
